Terms of Use

The following rules govern the use by you of V-ME ONLINE. The rules set forth herein apply to all materials, online communications and other information that is or becomes available on V-ME ONLINE (collectively, "Information"). BY SIGNING ON AND USING V-ME ONLINE, YOU SPECIFICALLY AGREE TO ABIDE BY THESE RULES AND ANY MODIFICATIONS THERETO.

1. Personal Uses Permitted.

V-ME ONLINE is an online information exchange service for use by V-ME, local Public television stations presenting V-me and the general public. You shall not post, publish, transmit, reproduce, distribute or in any way use or exploit any Information for commercial purposes or otherwise use the Information in a manner that is inconsistent with these rules and regulations.

2. User's Obligation to Abide By Applicable Law.

In connection with the use of V-ME ONLINE, you shall abide by all applicable federal, state or local laws, including those pertaining to such areas as libel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement ("Applicable Law"). The Information available on V-ME ONLINE may include intellectual property that is protected under the copyright, trademark and other intellectual property laws of the United States and/or other countries ("Intellectual Property Laws"). Such Intellectual Property Laws generally prohibit the unauthorized reproduction, distribution or exhibition of all text, photographic and graphic (art and electronic) images, music, sound samplings and other protected materials. The violation of applicable Intellectual Property Laws may give rise to civil and/or criminal penalties.

3. Disclosure of Online Communications.

You are cautioned that any online communications may not be fully confidential. In addition, you should be aware that federal postal regulations do not protect electronic mail. You should be aware that some administrative personnel of V-ME may, in the course of their regular duties, have access to communications for technical or operational purposes. V-ME may also disclose any communications to the extent permitted or required by law.

4. Prohibition Against Rogue Programming.

You shall not post, transmit or make available in any way through V-ME ONLINE any software or other materials which contain a computer virus, trojan horse, timebomb, worm or other rogue programming ("Rogue Programming"). V-ME has no obligation to detect the presence of any Rogue Programming. Any downloading of software or other materials or any other use of the Information on V-ME ONLINE is at your risk, and you are advised to take adequate precautions to minimize any loss to your system caused by Rogue Programming, including use of anti-virus programs and proper backup of files.

5. Content of Information.

You are responsible for the content of any Information you put on V-ME ONLINE. The Information posted to V-me ONLINE does not necessarily reflect the views of V-ME and in no event shall V-ME assume or have any responsibility or liability for any information posted to V-me ONLINE or for any claims, damages or losses resulting from the use and/or appearance of such information on V-me ONLINE. V-ME has no obligation to, and does not in the normal course, monitor or control any Information that is or becomes available on V-ME ONLINE. V-ME reserves the right to review any Information that is or becomes available on V-ME ONLINE. V-ME reserves the right to refuse to post or to edit or remove, in whole or in part, any Information that is, in V-ME's sole discretion, unacceptable, undesirable or in violation of these rules. V-ME has no obligation to exercise such reservation of rights by V-ME; however, V-ME has adopted and implemented a policy respecting the copyright law that provides for the termination in appropriate circumstances of users of the V-ME ONLINE system or network who are repeat infringers. V-ME may terminate access for content providers or forum participants who are found repeatedly to provide or post protected material without necessary rights and permissions. By submitting information to V-ME, you grant V-ME a perpetual, royalty-free, worldwide license to use, transmit, copy and display such information in any and all media now know or hereinafter devised and represent that you have all necessary rights in such posting. While V-ME strives to provide users with the highest-quality related resources on all of its sites, we cannot and do not ensure the quality or accuracy of the non-V-me.tv content to which we link.

6. Podcasts.

The MP3 audio files and XML files that together comprise a V-ME-hosted podcast (herein referred to as the "podcast") are protected by U.S. and international copyright laws. All rights to podcast(s) originating from the producer, including the content and technology included therein, are reserved to the producer. V-ME-hosted podcast(s) are available for personal, noncommercial use only. You may link to V-ME podcast(s) from your personal Web site and audio files may be downloaded and played on any system for personal, noncommercial purposes, provided that, unless permission to do so is expressly stated:

(a) you do not modify or delete any of the podcast content nor individual audio files; (b) you do not redistribute the MP3 audio files made available as part of the podcast nor any audio file downloaded from V-me.tv; (c) the use or display does not suggest that V-ME, local Public television stations presenting V-me nor the producer of the podcast(s) promotes or endorses any third party causes, ideas, Web sites, products or services; (d) audio files made available for download are not to be re-produced, edited, re-transmitted, or in any way repurposed without prior consent from the producer and V-ME.

Producers and V-MEreserve the right to discontinue providing podcast(s) and to require that you cease accessing or using the podcast(s) or any elements of the podcast at any time for any reason.

The podcast producer and/or V-MEmay modify any of the terms and conditions contained herein, at any time and at our sole discretion, and such terms and conditions will become binding when placed online.

Under no circumstances and under no legal theory, tort, contract, strict liability, or otherwise, shall the podcast producer, V-ME, nor any local Public television stations presenting V-me be liable to you or any other person for any indirect, special, incidental, or consequential damages of any character including, without limitation, damages for lost profits, loss of goodwill, work stoppage, accuracy of services, content or results, computer failure or malfunction, damages resulting from disabling of the services provided as part of the podcast(s).

7. Disclaimer of Warranties.

V-ME ONLINE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NONINFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER V-ME NOR THE PUBLIC TELEVISION STATIONS PRESENTING V-ME WARRANT THAT ANY INFORMATION IS COMPLETE OR ACCURATE, THAT V-ME ONLINE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION IS FREE OF ROGUE PROGRAMMING.

8. Limitation of Damages.

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL V-ME OR THE PUBLIC TELEVISION STATIONS PRESENTING V-ME BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE V-ME ONLINE, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON V-ME ONLINE, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE.

9. Release and Indemnity.

YOU HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST V-ME AND/OR THE PUBLIC TELEVISION STATIONS PRESENTING V-ME ARISING FROM OR IN CONNECTION WITH YOUR USE OF V-ME ONLINE, YOU ALSO AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS, V-ME AND THE PUBLIC TELEVISION STATIONS PRESENTING V-ME, FROM AND AGAINST, ANY AND ALL CLAIMS OR LIABILITY, INCLUDING COSTS AND ATTORNEYS FEES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF V-ME ONLINE OR FAILURE TO ABIDE BY APPLICABLE LAW.

10. Modifications.

These rules may be modified by V-ME from time to time and such modifications will be binding on you when placed online.

11. Terms and Conditions for Use of V-me e-commerce.

Please read the Terms and Conditions for Use of V-me e-commerce Agreement carefully before accessing the Service. By accessing the Service, you agree to be bound by the terms and conditions below.

For Families Visiting V-ME:

You have trusted Public Television for many years to make safe and quality content that family members of all ages can enjoy. In the cyberspace world, this trust is even more important to your family, and to V-ME. To make sure that this site stays safe and fun, we make the following promises:

  • In almost all activities, the information we collect is non-personal (such as first name, age, city and state). If you enter a contest, send us a question or send an electronic postcard, we will also ask for an e-mail address. We only collect enough information from our visitors to make activities on V-ME fun and interesting.
  • If you submit stories, artwork, comments or anything else to us which is posted on our site, you will be identified on our site only by first name, city and state.
  • If you send us an e-mail with a question or comment, or enter one of our contests, we will write back using your e-mail address, but we will not keep the address or use it again.
  • If you ask V-ME to send an electronic postcard or e-mail message, we will ask for your first name and e-mail address as well as the e-mail address of the person who will receive the postcard. We will only use this information to send the postcard or message and we will delete the information when the postcard or message is sent.
  • No one will be excluded from our site for not giving us personal information. When we do ask for personal information (like an e-mail address), we will only keep it until that particular activity is complete. We will not share this information with a third party.
  • If we know a visitor is under the age of thirteen, we will collect a parent's permission offline (by postal mail, fax or phone) before we mail any prizes, or collect or share personal information with anyone else.
  • When you create a username and password on V-ME KIDS GO!, we do not collect any information that would allow us or anyone else to identify you. When prompted to create a username, we recommend you use non-personally identifiable information. Your login information is only used in games and activities where users might want to save points and creations, such as EekoWorld.

As you visit V-me.tv, it is possible that several cookies* will be set on your computer. V-ME uses the information from cookies to deliver relevant local resources, remember browser preferences, and improve our visitors' experiences on the site. No personal information is ever stored in a V-ME cookie, even if you have entered your name or e-mail address on other parts of V-ME K.

V-ME does not sell information collected by cookies or use the information for commerce-related purposes. In addition, V-ME will not filter content based on your preferences without permission.

*What's a cookie? A cookie is information a Web site puts on your computer's hard drive so that the site can remember your preferences or which pages you visited on that site.

V-ME only uses cookies at the following times:

  • If you localize V-me.tv to the Public television station presenting V-me nearest you, a cookie will tell us your station's call letters. V-ME only keeps track of how many computers choose each station. You can choose to have your computer remember a different station, or no station at all, at any time. Please note that if you come to V-me.tv from a local station site, and you were not previously localized to a station, you may be automatically localized to that station.
  • If you watch a video clip or listen to an audio clip on V-me.tv, a cookie will remember which media player (such as Real Player or QuickTime) and which type of clip (high or low bandwidth) you prefer to use on your computer. You can change your video and audio preferences at any time, or choose a player each time you view or listen to a clip.
  • As you explore V-me.tv, a cookie will tell us which pages you visit and the amount of time between each page visit. This cookie does not remember any information about you or your computer; it just helps us at V-ME identify new and repeat visitors, and tells us how long visitors spend on our sites and which pages receive the most traffic.

When a V-ME site is partially funded by outside sponsors, we will mark any underwriter logos with a "sponsored by" tag. We choose our underwriters carefully, to make sure that the company's products and services fit V-ME standards.

  • As you and your family experience the V-me site, you may encounter links to third party sites. While we choose our partners carefully, we cannot be assured that links to outside sites follow our safety or privacy guidelines in all cases. We are not responsible for the content or safety and privacy practices at any sites linked from our pages.

Your family's use of this site is conditioned on your having accepted these terms. You should check back to this policy frequently, since it is subject to change from time to time, and your continued use of the site is conditioned upon your acceptance of any modifications hereto.
